If you bring a personal grievance because of redundancy, the Employment Relations Authority won’t just take your boss’s decision or make its own. It will decide what a ‘fair and reasonable’ employer could have done.
The ERA will look at whether your boss offered you counselling, career and financial advice, and retraining.
They’ll also look at the process your employment agreement sets out for redundancy. They’ll hold your boss to that process unless it’s not fair and reasonable, for example it has an unreasonable notice period for redundancies.
