Your employer can make you redundant while on parental leave. If you challenge them, they have to prove the job became redundant after they told you (responding to your parental leave notice) they could keep your job open. Your boss also has to prove they couldn’t give you a job much like your old one. They also have to meet the usual redundancy requirements - the decision and process must be fair and reasonable. They need to consult you and give you a chance to give input.
The Employment Relations Authority treats parental leave complaints similarly to personal grievances.
