If there’s a collective agreement when you start work and you belong to the union, you’ll be covered by the agreement. If you’re not a union member, you can join and then you’ll be covered by the collective agreement. If there’s no collective agreement, or if you’re not a union member, you’ll have an individual employment agreement negotiated between you and your employer.
When your boss offers you an individual agreement, they have to tell you there’s a collective agreement for your work, that you can join the union, and how to contact the union. If there’s more than one collective agreement, the one that binds more employees is the one your boss has to tell you about. They also have to tell you that if you join the union, the collective agreement will bind you, give you a copy of the collective agreement, and if you agree, tell the union that you’re on an individual agreement.
If you join the union at any time, you automatically join the collective agreement (as long as it covers your work). If you have a minimum wage exemption permit, you’ll be paid the rate in the permit as long as the union agrees.
