Can my employer refuse negotiated parental leave if I don't qualify for normal parental leave?

You may qualify for parental leave payments but not primary carer leave from your employer (say if you changed jobs recently). You can ask your boss to let you take ‘negotiated carer leave’ so you’ll qualify for the payments. You have to ask your boss in writing 3 months before the birth due date, or at least 2 weeks before you start taking care of a child under 6. Your boss has to reply as soon as possible within a month, and give reasons if they say no.
