If you bring a personal grievance for unjustified dismissal, the Employment Relations Authority will look at what a fair and reasonable employer would have done in the situation. They’ll consider whether your boss had good reason to dismiss you (‘substantive fairness’) and whether they followed a fair process (‘procedural fairness’).
Something being ‘substantively fair’ in a dismissal will depend on the circumstances. Reasons can be grouped into either serious misconduct justifying immediate, ‘summary’ dismissal, or less serious misconduct where your boss has to give you warnings and the chance to change your conduct or improve your performance.
