If either side is unhappy with an ERA decision they can challenge it by asking within 28 days for the Employment Court to hear the case. You can challenge either the whole of the written decision by asking the Court to hear the whole matter (a hearing ‘de novo’), or just a part of the decision. You can’t challenge the ERA’s procedure.
The Employment Court can include hearing Employment Relations Authority decision challenges, reviews of how officials have used their powers, damages applications, injunctions or compliance orders related to an unlawful strike, lockout or related picketing, declare who is an ‘employee’, and hearing claims that a person has breached the Act.
Related *picketing* is when people congregate outside a workplace, which is not unlawful in itself. But picketing that forms part of an unlawful strike or lockout may be ruled unlawful by the ERA.
