Employers and unions must deal in good faith, for example they must:
• try to agree on an effective bargaining process
• meet to discuss, consider and respond to proposals
• keep bargaining, even if a deadlock is reached
• come to a collective agreement unless there’s a genuine reason not to, based on reasonable grounds
• respect each other’s representative and bargain only through the representative
• provide information to support their claims or responses.
Good faith doesn’t mean an employer and union must reach an agreement. Employers can opt out of collective bargaining that involves other employers. They can’t refuse on principle to enter into any collective agreement.[Code of Good Faith in Collective Bargaining www.employment.govt.nz]
