If you take yearly holidays, your holiday pay is the higher of your usual weekly pay when you take the holiday, or your average weekly pay for the 12 months just before the end of the last pay period before the annual holiday. If you work less than 12 months, you get paid 8% of your gross earnings, less any holiday pay paid early.
Your holiday pay should be proportional to the hours you normally work, i.e. your average weekly earnings. It must be an identifiable part of your pay and you can ask your employer to show you how it's been calculated and what's been included in your gross earnings.
Payment for holidays and leave must be calculated each time you go on holiday or leave, as the rate of payment may change even from pay period to pay period.
