If you’ve been called up for jury service you must attend and your job is protected while you do so. Your employer must allow you to attend jury service, and it’s illegal to require you to use your annual leave to cover time off for jury duty. If your absence from work causes difficulty for your employer because of special commitments, your employer can give you a letter to support your application to be excused or have your service deferred.
Your employer can’t dismiss or threaten to dismiss you or otherwise threaten your position for attending jury service. If they do, they could be convicted of an offence and fined up to $10,000, and you could bring a personal grievance.
If you attend jury service, you receive a small attendance fee from the Ministry of Justice. Your employer doesn’t have to pay you while you do jury service, but many choose to ‘top up’ the money you get from the Ministry of Justice so you get your normal pay. You can check your employment agreement and workplace policies or talk to your employer to see if you can get a top-up.
