The Privacy Commissioner’s checklist for best practice of CCTV recording includes the following points:
• There’s a clear purpose for CCTV recording, and a named individual is responsible for the operation of the system. Your employer has chosen CCTV cameras and other equipment that are suitable for their purpose and they’re operating properly.
• CCTV cameras aren’t located in places that intrude on the privacy of individuals (such as bathrooms, backyards, through windows etc) and there is visible signage that CCTV is in operation. Where it’s not obvious who’s responsible for the system, your employer’s name and contact details are on the signs.
• CCTV cameras only operate when necessary, such as during opening hours or days and times of the week when crime peaks.
• CCTV footage is only used or disclosed for the outlined purpose and not for any other reason. Individuals can access CCTV images of themselves, but your employer must also protect the privacy of others in the footage and keep a log of who has accessed CCTV footage, including individuals and the Police.
• Images are transmitted and stored securely and kept for a specified time, which must be no longer than necessary to achieve the outlined purpose. Regular checks ensure the system is working properly.
