If you’re working for a trial period, you get all the minimum employment rights and responsibilities (health and safety, minimum pay, annual holidays, public holidays, sick and bereavement leave and equal pay), except bringing a personal grievance for unjustified dismissal. Your boss has to treat you the same as other workers who aren’t on a trial period.
Even if you’re on a trial period, you can still bring a personal grievance on grounds other than your dismissal, for example discrimination, sexual or racial harassment, pressure about union membership, continuity of employment under Part 6A of the Employment Relations Act 2000, or if your boss does something that unjustifiably disadvantages you. Mediation is available at any time.
