Employers can be given penalties for breaching health and safety laws. This can be *breaching a duty* where no-one is exposed to a serious risk. An individual can get a fine up to $100,000, or $500,000 for a company.
If an employer breaches their duty and creates a *serious risk* of death, injury or illness, they can get a fine up to $300,000 as an individual, or $1.5 million for a company. *Reckless* creation of a serious risk can lead to a jail term up to 5 years and/or up to $600,000 fine for an individual. A company can be fined up to $3 million.
