Investigative meetings are dealt with by one member of the Employment Relations Authority by themselves and control how the meeting runs. The Authority can summon witnesses or other people, require any books, papers or other documents be shown, take evidence under oath or affirmation, and make a decision if either side doesn’t attend and has no excuse.
You can choose to represent yourself or by represented by someone else at an ERA investigation meeting. Your representative doesn’t have to be lawyer - it can be a union representative or bargaining agent. Legal aid may be available for cases before the Employment Relations Authority.
After hearing the facts, the Authority member usually needs to give their decision orally, or give an oral indication of their preliminary findings. If they give an oral decision, they need to give a written decision within a month, but if they give an oral indication, they have 3 months. The Authority’s decision is enforceable the same way a court order is.
