A collective agreement expires on whichever comes first out of an expiry date, an event, or three years after it begins - unless bargaining starts before it expires, if so it will stay in force for up to 12 months.
When it expires, each employee automatically has an individual agreement based on the expired one, plus any other terms and conditions agreed before. You and your boss can agree to change this individual agreement or negotiate a new one from scratch. If a collective agreement later comes into effect, union members automatically move off any individual agreement onto the collective one.
If there’s no current collective agreement that covers them, new employees will be on an individual agreement negotiated with the employer even if they are members of the union.
