The policy should set out what happens if there’s a non-negative or positive result. This must involve discussion of the results with the employee, and possibly retesting the sample. The procedure will depend on the nature of the industry or work activity, and the health and safety, or reputational, risks. If your contract or code of conduct or work policies say that you will be dismissed or put into a performance management scheme in the case of a positive drug test, then you have breached your contract.
