The Employment Court's first step when dealing with a dispute is to check whether the two sides have tried mediation to resolve the problem. It must order them to try mediation unless it would serve no constructive purpose, would not be in the public interest, or would undermine the urgent or interim nature of the case.
The Court can decide the case in a way that is consistent with the law and the relevant employment agreement. It can hear evidence and get information that might not be admissible in other courts. Either side can apply to the Court of Appeal for permission to appeal the Employment Court’s decision. They must apply within 28 days of the Employment Court’s decision.
