When you ask for flexible work arrangements, your boss has to write back to you within a month or ideally sooner to say what they’ve decided, and if they say no, they must explain why not. They can only say no for one of the reasons in the Employment Relations Act for example, they couldn’t reorganise your work among the other staff, they couldn’t recruit new people, it would affect work performance, or there wouldn’t be work at the times you want.
If your boss doesn’t respond as required or uses a reason that’s not permitted, you can ask a labour inspector for help. They can refer you to mediation, and if that doesn’t work you can apply to the Employment Relations Authority. If they agree your boss has breached the requirements, they can tell your boss to pay you a penalty up to $2000.
