If you think you’re not being allowed to have the breaks you’re entitled to, you should first raise the matter with your employer. The Labour Inspectorate expects that you and your employer will be able to work out how and when you’ll take breaks. If you can’t agree, you can contact MBIE.
If you’re a union member, you can seek assistance from your union. You can go to mediation, and if you still can’t agree then the Employment Relations Authority can determine the matter. If a case is serious enough for the Labour Inspectorate to get involved, they may well seek penalties if they decide there’s been a breach.
