Worksafe NZ is the government agency responsible for enforcing health and safety laws. Their inspectors have the right to enter any workplace to ask questions, gather information, and take samples. It’s a crime to delay or stop them from doing their work.
If an inspector has investigated a health and safety problem at your workplace, they can:
• decide to take no action;
• speak or write to your boss about health and safety practises;
• give them a written warning;
• give your boss an improvement notice to comply with the law;
• give them a prohibition notice to immediately stop a particular activity; or,
• give them an infringement notice with a fine.
In serious cases Worksafe NZ can bring a criminal prosecution.
