Sexual harassment is when your employer:
• asks you for sex, sexual contact or other sexual activity, either by promising (openly or implied) better treatment, or threatening (openly or implied) worse treatment, or your current or future job security
• behaves in a way that’s unwanted or offensive to you (even if you don’t tell your employer it is), and that's so significant or repeated it affects your employment, or your job performance or satisfaction.
This can be with sexual language, or sexual visual material (pictures, diagrams, photos, videos), or through sexual physical behaviour.
Sexual harassment can happen to and by someone of any sex, and it can be subtle or obvious. Whether a behaviour was sexual harassment is viewed objectively, considering whether the conduct was unwelcome or offensive, from the perspective of the complainant. You may have a personal grievance if your employer or their representative sexually harasses you.
