Unions can initiate collective bargaining 20 days ahead of an employer. For a single employer collective agreement between a union and employer, the union can initiate bargaining within 60 days of the agreement expiry, while the employer can only initiate within 40 days.
If there’s more than one collective agreement, the earliest date a union can initiate bargaining is the later of two dates: within 120 days before the date the last collective agreement expires; or within 60 days before the date the first one expires. For employers, the timeframes are 100 days and 40 days.
To calculate the 120- or 60-day period, the union or employer needs to work out which employees’ work is covered by the proposed collective agreement, checking if any of them are covered by a collective agreement and, if they are, when it will expire, and how many days will pass before that date.
