If you take an annual holiday, you must be paid for all of it before it starts unless you agree to be paid in your normal pattern. You and your boss should agree in writing to make sure you both understand. If your employment is ending, your employer must pay your holiday pay in your final pay.
If you work so irregularly that you can’t get 4 weeks off on annual holidays, or if you’re on a fixed term agreement for under 12 months, you can get 8% of your gross earnings as holiday pay with your regular pay instead of taking holidays. This must be in your employment agreement and shown as a separate item in pay records and your payslip.
You must be paid for public holidays in the pay period when the holiday falls if it’s usually a working day for you. If you work on a public holiday you must be paid at least time and a half. You must be paid for sick or bereavement leave in your pay for the period when you took leave, at the rate you would usually be paid. If your employer needs proof you were sick, they don’t have to pay your sick leave until you’ve given them the proof.
